Welcome to Perspective (perspective.co.ke). These Terms of Service ("Terms") govern your access to and use of the website, mobile platforms, newsletters, and services operated by Perspective Media ("we," "our," or "us").

1. About Perspective & Services

Perspective is an independent, digital-first Kenyan news publication providing news reporting, analysis, explainer articles, and opinion commentary covering Kenya, East Africa, and global affairs.

We reserve the right to modify, suspend, or discontinue any section, feature, or content on our platform at any time without prior notice.

2. Intellectual Property Rights

  • Our Content: All articles, reports, graphics, photographs, logos, audio, video, software code, and visual layouts on Perspective are owned by or licensed to Perspective Media and are protected under the Copyright Act (Cap 130 of the Laws of Kenya) and international copyright treaties.
  • Limited Personal License: You are granted a limited, revocable, non-exclusive, non-transferable license to access and read our content for personal, non-commercial use only.
  • Restrictions: You may not copy, reproduce, republish, mirror, scrape, frame, modify, or commercially exploit any content from Perspective without prior written permission from our editorial desk.
  • Fair Sharing: You may share links to our articles on social media or via personal communication, provided you do not alter the content, strip attribution, or imply endorsement by Perspective. Brief excerpts with direct linking back to the original source are permitted under fair dealing rules.

3. User Submissions & Contributions (Op-Eds, Comments, Letters)

When you submit an opinion piece, pitch, letter to the editor, or comment to Perspective:

  • Originality & Warranties: You guarantee that the content is your original work, does not violate copyright, is factually accurate to the best of your knowledge, and is not defamatory, libelous, or unlawful under Kenyan law.
  • Grant of License: By submitting content, you grant Perspective a royalty-free, perpetual, worldwide, non-exclusive license to publish, edit, translate, archive, and distribute your submission across all our digital platforms and syndication channels.
  • Editorial Moderation: We reserve the right to edit for length, clarity, tone, and legal compliance, or to reject/remove any submission at our sole discretion without obligation to provide justification.

4. Prohibited User Conduct

When accessing or using our platform, you strictly agree NOT to:

  • Breach Cyber Laws: Engage in activities that violate the Computer Misuse and Cybercrimes Act (No. 5 of 2018), including attempting unauthorized access, distributing malware, or executing Denial of Service (DoS) attacks.
  • Automated Scraping: Use bots, crawlers, scrapers, or automated tools to extract data or content without explicit written consent.
  • Spam & Misinformation: Use our contact forms or submission channels to send unsolicited marketing, spam, false news, or deceptive material.
  • Hate Speech & Harassment: Post or send content that promotes hate speech, violence, ethnic incitement, harassment, or defamation against any individual, community, or group.
  • Impersonation: Impersonate any journalist, editor, staff member of Perspective, or third party.

5. Editorial Disclaimer & Accuracy

  • General Information: Content published on Perspective is provided for general informational, educational, and analytical purposes only. It does not constitute formal legal, financial, medical, or professional advice.
  • Opinion Pieces: Views expressed in op-eds, guest columns, or reader comments belong solely to the respective authors and do not necessarily reflect the official editorial stance of Perspective.
  • Corrections: In line with our Accuracy First ethos, if you identify a factual error in our reporting, please notify us at corrections@perspective.co.ke. Valid errors will be corrected promptly with transparent updates.

6. Third-Party Links & External Websites

To the fullest extent permitted by the laws of the Republic of Kenya:

8. Indemnification

You agree to defend, indemnify, and hold harmless Perspective Media, its directors, editors, writers, and employees from and against any claims, liabilities, damages, judgments, or costs (including legal fees) resulting from your violation of these Terms or your unauthorized use of our site.

9. Governing Law & Dispute Resolution

  • Governing Law: These Terms shall be governed by, interpreted, and enforced in accordance with the Laws of the Republic of Kenya.
  • Amicable Resolution: In the event of any dispute or claim arising out of these Terms, the parties shall first attempt to resolve the matter through good-faith informal negotiations with our legal desk.
  • Jurisdiction: If an amicable resolution cannot be reached within 30 days, the dispute shall be subject to the exclusive jurisdiction of the competent courts sitting in Nairobi, Kenya.

10. Changes to These Terms

We reserve the right to revise these Terms at any time. When updates occur, we will revise the "Last Updated" date at the top of this page. Your continued use of Perspective following posted changes signifies your acceptance of the updated Terms.
